Serious Accident in Jacksonville, Florida on I-10 Kills One and Injures Several Others. Alcohol Possibly Involved.

An accident on I-10 near Marietta Street in Jacksonville, Florida resulted in one death and several serious injuries, according to an article on News4Jax.com. The article indicates that a pickup truck driver struck a van near an exit ramp causing the van to hit the concrete barrier and overturn. The van had eleven passengers, many of whom were children. Eight of them were injured and one was killed in the accident.

The driver of the pickup truck may have been drinking, according to preliminary reports from the Florida Highway Patrol (FHP) officer who was investigating the fatal crash. The accident occurred around 2:00 in the morning.

Tatas, Birlas to Invest in Real Estate

Two of India’s large business houses, the Birlas and the Tatas, are looking at real estate as a major investment area, albeit in different ways.

While the Birlas, through a financial services arm, are offering real estate as an alternative investment option to clients, the Tatas are planning to develop surplus land held by group companies. The Tatas may also invest in the sector part of funds raised through recent public offerings.

These moves come at a time when real estate prices are correcting and low demand for projects has prompted large developers to default on financial commitments and project deadlines.

Aditya Birla Management director Ajay Srinivasan, who also heads the financial services business, said the conglomerate is merely gearing up for the future. “We are now putting a team in place and want to be ready when the time is right, ” he told ET.

The financial services arm of the group is setting up a real estate and private equity arm for its wealth management units. To be headed by Sashi Kumar, the real estate business would be managed through Birla Sun Life Asset Management. The Birlas plan to subsequently launch two real estate funds, one offshore and the other local, for the sector.

Although funds will be raised overseas as well, the investment destinations will be in India and can include distressed real estate assets. Tata Housing Development, a real estate player, has already said that it plans to leverage its tie-ups with banks by developing properties on surplus land owned by other Tata group companies.

Tata Housing is now identifying excess landbanks owned by companies such as TCS, Voltas, Rallis India, Tata Motors, Tata Coffee and Tata Tea. Tata Capital, the financial services arm of the Tatas, is scheduled to close a largely successful non-convertible debenture issue on Tuesday; it has so far raised Rs 2, 300 crore against a targeted Rs 1, 500 crore. Although Tata Capital has said that it won’t lend to group companies, it has proposed to invest in most asset classes.

Anticipating a large value erosion in the realty space, Indian corporates are planning to float new funds to acquire assets in the domestic property market. Real estate funds such as Saffron Advisors have either floated or are in the process of floating funds with corpus ranging between Rs 500 crore and Rs 1, 000 crore.

“As far as Indian realty is concerned, for the right projects, funds are still available, ” said Saffron Advisors MD Ajoy Kapoor. “Conservative European investors, after conducting extensive due diligence and research, are more comfortable with investing in Indian real estate, provided they are able to align with right partners, ” he added.

A few months ago, Munich-based retail aggregator Deutsche Capital Management underwrote $20 million for Saffron India Real Estate Fund I, an India-focussed real estate fund. DCM is raising a specific fund for investing in Indian real estate through Saffron Advisors.

Tough lending norms, unfavourable primary market and global financial worries have affected fund flow into the Indian property market. Real estate deals have fallen and fancy valuations by developers are being corrected to a large extent.

Semi Truck Crosses Median on I-95 Near JTB and Crashes in Bad Weather in Jacksonville, Florida

A semi truck crashed into other vehicles on I-95 near J Turner Butler Boulevard (JTB) in Jacksonville, Florida causing injuries after days of heavy rain, according to an article on Firstcoastnews.com. The weather the last few days in Jacksonville and other areas of Florida has been terrible with constant rain and heavy winds. The roads are soaked with pockets of standing water. This makes for very dangerous conditions which are expected to continue for a few days.

Those of us driving on the roads in the Jacksonville, Florida area may have seen a higher number of accidents, which of course are more common in such poor weather. The semi truck accident referenced in the article above is just one example of many.

When people get injured in accidents, whether they are caused by semi trucks or other vehicles, can the driver who caused the accident use the poor weather and driving conditions as an excuse? When we represent people who have been injured in an auto accident or had a family member killed in an accident, we certainly do not accept poor weather as a valid defense to negligent driving. We do not expect that juries in a personal injury or wrongful death lawsuit will either. When the weather is bad, whether it is due to rain, high winds, hail, fog, poor visibility or some other factor, we expect that people drive more carefully. Drivers must drive more slowly and be more alert to possible hazards caused by the weather. A person who is speeding, or even driving the speed limit, in poor weather cannot use the weather as an excuse if he/she was following another vehicle too closely and was unable to stop in time causing an accident. This is particularly true for semi trucks which are bigger, heavier, harder to stop and cause much more damage when they crash into other vehicles.

Defendant drivers in personal injury and wrongful death lawsuits will sometimes blame the crash on the weather. However, it is important to understand that not only is the weather a poor excuse for an accident, it can often be used as a factor that supports the defendant driver's negligence because he/she failed to take the proper precautions and was driving dangerously as a result.

Serious Accident in Jacksonville, Florida on I-10 Kills One and Injures Several Others. Alcohol Possibly Involved.

An accident on I-10 near Marietta Street in Jacksonville, Florida resulted in one death and several serious injuries, according to an article on News4Jax.com. The article indicates that a pickup truck driver struck a van near an exit ramp causing the van to hit the concrete barrier and overturn. The van had eleven passengers, many of whom were children. Eight of them were injured and one was killed in the accident.

The driver of the pickup truck may have been drinking, according to preliminary reports from the Florida Highway Patrol (FHP) officer who was investigating the fatal crash. The accident occurred around 2:00 in the morning.

Any time there is an accident of this nature with a death and serious injuries, particularly with children involved, it is important to explore all of the factors that caused and contributed to the crash. Since there is some indication that alcohol was involved, that is a good starting point. Accident attorneys can look at the crash report and note any signs of impairment from alcohol and/or drugs that are reported by the responding FHP officer. Additionally, there may be an arrest and booking report prepared by a Jacksonville Sheriff's Office (JSO) officer that will go into more detail as to whether the at-fault driver was drunk or otherwise impaired by alcohol or drugs. Witnesses from the scene of the accident can also testify to signs of impairment. Another possible source of information would be medical records of the at-fault driver if she was injured and treated. The ambulance report and the ER reports can have useful information including incriminating statements made by the driver, notes of observations from medical personnel such as an odor of alcohol and results of blood tests that show a blood alcohol content over the legal limit.

There are several ways for personal injury and wrongful death lawyers to learn about the condition of an at-fault driver, particularly if alcohol or drugs were a factor in the accident. For a serious accident like this one, it is important to explore all possible factors that may have contributed to the crash.

New Study Finds Aggressive Driving is a Major Factor in Fatal Auto Accidents

Approximately 56% of auto crashes that resulted in a death were tied to aggressive driving according to a recent study by the AAA Foundation. The AAA study examined almost 200, 000 auto crashes that resulted in over 210, 000 deaths in the U.S. from 2003 - 2007. Numerous people were also interviewed to determine their concerns and driving habits. Aggressive driving is one of those terms where you often know it when you see it, but for the purposes of this study, it included speeding, improper lane changes, driving on the shoulders of the road, illegal passing, speeding up to beat a yellow light, running a red light, failing to signal, ignoring road signs and failing to yield the right of way.

It seems obvious to say that the more responsible and defensive people drive, the fewer serious and fatal accidents we will have. This study confirms that and quantifies that statement to a degree. It was also interesting that most people interviewed recognized aggressive driving as a serious problem that contributes to serious accidents, but many of those same people admit to aggressive driving themselves. For instance, those people surveyed admitted to the following (males under 40 years old were the worst offenders):

- driving 15 mph over the speed limit in the last 30 days: almost 50%
- speeding up to beat a yellow light: 58%
- tailgating: 22%
- running red lights: 6% (I'm guessing this number should be higher.)

In many wrongful death lawsuits resulting from serious fatal crashes, this kind of aggressive driving is a factor as this study would suggest. As wrongful death attorneys, it is our job to uncover the evidence of such aggressive driving on the part of the at-fault driver and show how it caused the accident and the tragic loss of life.

This is partially due to Yahoo losing MSN as a client. Google has been innovative in search targeting and channel expansion while Yahoo has endured some delays.

With that said, both tools can be useful. However, Google allows slightly more precise targeting. And, depending on your niche, it can get expensive. The best way to go is optimizing your site. If you sell "shoes in Buffalo, NY, " just make sure your main page includes those terms in the copy, title bar, and meta description. If so, you should rank pretty well.

With that said, ad words can be a good back up until you rank well. And, some claim companies enjoy superior results if they rank well organically and have ad words. And, more is often better than less (well, according to Yahoo and Google). But, it's worth looking at the return on investment.

Steve and Barry's has unveiled Starbury shoes and clothing. Steve and Barry's is known for having a store full of products that go for under $10. Starbury--Stephon Marbury's line--will go at a "premium" of $10-$15. Now, here's what is neat about this story: not only is he promoting this line, he's actually going to wear this brand of shoes in the games. In fact, the president of the company said he's just going to pull a pair from a Steve and Barry's on gameday.

So, when he hits the courts and is performing as well as anyone with $15 shoes, it seems like it's bound to make a real statement. Will it really hurt Nike and the like? I doubt it, as kids will still crave products that are difficult to get. But, it'll make it easier for parents to show their kids that expensive shoes don't make the difference. And, from checking out some blogs online, people seem to be happy with how these shoes perform. Kudos to Marbury for backing up his endorsement by agreeing to wear these shoes in games.

I've always been impressed with Steve and Barry's. Considering the volume, stores seem to be maintained fairly well and the employees appear relatively happy. And, they've managed to undercut the big boys while providing quality that is certainly no worse than the discount stores provide. Given that everything is offshored anyways, I'll be happy if they succeed and get people to shift their other disposable dollars elsewhere. I just wonder if the big discounters feel threatened yet.

SACRED KAVA
KAVA plays an essential role in the daily lives of many Pacific Islanders. Often thought of as one of the most precious gifts of the earth, it is a pleasant drink that can be used safely as an alternative to alcohol. Kava is a well known ‘folk-remedy’ to many Islanders and is used by tribal healers for it’s medicinal purposes. Ceremonial occasions are also marked with Kava such as weddings, festivals, holidays, and even funerals. It has become a status symbol in many cultures around the world and is still widely used in places like Fiji and Hawaii. Known as ‘AWA’ in Hawaii, native stories suggest the origin of Kava as being brought from the ancestral homeland of Kahiki (the ancestral homelands of various islands of lower and middle Polynesia), and was planted throughout the islands by gods Kane and Kanaloa.(Kane was the ancestor of the chiefs and commoners, forest, fresh water, sunlight and verdant growth; and Kanaloa was the Hawaiian god of the ocean, marine life, and healing. Some Fijian communities pound Kava root with a stone to make ‘yagona’ which may be passed around in a circle of gatherers by village elders using the sacred bowl or ‘tanoa’ . Each member of the circle then offers a toast ‘ Bula (meaning health or life). Traditionally a Kava drink or “tea” is prepared from the root (the only part of the plant that is used). The cloudy brew is made by pounding and grinding the root, a labor intensive task that is usually reserved for young eager males. Modern procedures usually involve power operated machinery such as a mulcher which turns the root into pulp. There are so many ways in which to drink your Kava but it is traditional to set a moment of the day aside “Kava time”, where a mood is set with friends and family to forget about your daily routines and sit back and relax. In the South Pacific Islands where coconut shells are abundant Kava is enjoyed from a shell but if a coconut shell isn’t handy it might be fun to use a special cup of your own choosing. Either way it is a time to share, appreciate and enjoy! So Drink up and Bula!
